A Legacy of Holding The Tobacco Industry Accountable

For more than four decades, Public Health Advocacy Institute has been at the forefront of public health litigation, using law and policy to challenge industries whose products and practices contribute to addiction, disease, and preventable harm.

Our organization’s work was created from the efforts of our President Richard Daynard, who led the legal movement against Big Tobacco at a time when few believed the tobacco industry could ever be held accountable.

Professor Daynard’s work shaped the legal strategies that transformed public health law, exposed decades of industry deception, and contributed to landmark tobacco settlements and stronger public health protections nationwide.

At PHAI, we continue to work to change the legal landscape surrounding tobacco litigation and public health policy in the U.S.

Nicotine-Free Generation in Massachusetts

Massachusetts is the first place in the world to pass local laws and regulations to create a Nicotine-Free Generation (“NFG”).

These are simple sales restrictions placed on retailers. They can sell commercial tobacco products (e.g., cigarettes, vapes, etc.) to anyone who was 21 years of age or older on an effective date. For example, such a date could be January 1, 2006.

If so, those retailers can sell tobacco products to anyone who is at least 21 years-old born before January 1, 2006. To everyone else, now and in the future, retailers will never be allowed to sell commercial tobacco products.
